Thank you for visiting our website and/or App [jojcleaningservices.com.au] (“Website”). This website is owned and operated by Janie O’Jeffrey’s Cleaning Services (ABN 51 335 805 232) (“Cleaning Services”).

By accessing and/or using the Website and related services, you agree to these Terms and Conditions, which include our Privacy Policy (“Terms”).

In these Terms, ‘us’, ‘we’ and ‘our’ means Cleaning Services and our related bodies corporate.

2. Acceptance of Terms

You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept to the Terms where this option is made available to you. Cleaning Services has the right to modify the policies, conditions, payments, fees and these Terms at any time.

You acknowledge that the Website is a platform that provides facilitation services to Clients. We will let you know within 24 hours of the booking if we cannot provide the services to you.

3. Registration

You may be required to register an account through the Website (the “Account”) before you can fully utilise it.
An account holder warrants that any information provided in the course of completing the registration process will always be accurate, correct and up to date.

To create an account, you must:

provide your name, email address and telephone number;
possess the legal right and ability to enter into a legally binding agreement with us;
have the authority to represent a third party (if applicable) and bind the third party to the Terms.

We reserve the right to reject a registration or remove a profile from the Website at any time at our absolute discretion.

4. Collection Notice

We collect personal information about you in order to respond to your enquiry or provide you with further information and for purposes otherwise set out in our Privacy Policy.

We may disclose that information to third parties that help us deliver our services (including information technology suppliers, communication suppliers and our business partners) or as required by law. If you do not provide this information, we may not be able to provide all of our services to you. We may also disclose your personal information to recipients that are located outside of Australia.

5. Accuracy, completeness and timeliness of information

Images of the products or services are just for illustration purposes. While we use all reasonable attempts to ensure the accuracy and completeness of the information on the Website, to the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the information on the Website.

We are not liable to you or anyone else for interference with or damage to your computer systems occurs in connection with the use of the Website or a linked website. You must take your own precautions to ensure that whatever you select for your use from Cleaning Services is free of viruses or anything else (such as worms or Trojan horses) that may interfere with or damage the operations of your computer systems.

We may, from time to time and without notice, change or add to Cleaning Services (including the Terms) or the information, products or services described in it. However, we do not undertake to keep Cleaning Services updated. We are not liable to you or anyone else if errors occur in the information on the Website or if that information is not up-to-date.

You agree that you will not hold us responsible for any damage caused directly or indirectly as a result of the services which were facilitated through the Website.

6. Fees

Quotations and Additional Costs (Exit & Residential Cleans)

(a) Quotations and Additional Costs (Exit & Residential Cleans)

Cleaning Services will provide a quote only after conducting a site visit. All premises must be inspected in person prior to work commencing in order to assess the condition of the premises and the specific cleaning requirements.
We offer a free walkthrough and quote, during which we will discuss the scope of the work with you.
Any additional tasks (e.g. oven cleaning, window cleaning) are subject to additional costs.
You will be informed of all associated fees prior to commencement, ensuring full transparency and no hidden costs.

(b) Payment Terms

For an exit clean, you must provide us with a 50% deposit prior to the Services.
Payment for Exit Cleans may be made in cash (exact amount only – no change will be provided) or via direct deposit (no bank charges applicable).
A remittance advice for Exit Cleans must be provided before work commences.
Payment for Residential Cleans is required on the day of service or upon completion.
You will be issued with a tax invoice for Residential Cleans and Exit Cleans, which will indicate either payment in full or amount owing.

(c) Conditions of Guarantee: Cleaning Services’ guarantee will not apply where:

The customer has not paid in full for the goods and/or services supplied;
The customer has breached any of these terms and conditions;
The areas to be cleaned are damaged or in a condition that makes cleaning ineffective or impossible

7. Cancellation Process

(a) Cleaning Services is committed to providing the best service in a timely manner. We aim to accommodate your needs.

(b) Unfortunately, when a Client cancels without giving adequate notice, it prevents another client from being served.

(c) We understand situations can arise in which you must cancel your appointment. Due to limited appointment availability, we request that you cancel with adequate notice. This allows us to fill that appointment slot.

(d) You may cancel by contacting us by email or through the Website.

(e) We require a minimum of 1 days’ notice of your appointment for cancellation.

(f) If you cancel an exit clean within 24 hours of the appointment, you will forfeit the deposit.

(g) If you do not provide at least one (1) full days’ notice of cancellation, or if you cancel with less than 24 hours’ notice, you will be charged the full fee for the scheduled service.

8. Non Solicitation

(a) Where a client and its employees, agents, representatives, related entities or associated entity contacts a cleaner for the engagement of further services outside the Website, the cleaner must direct the Client to engage the cleaner through the Website.

(b) The cleaner and the Client must use the Website as its exclusive method when agreeing to engage in further services.

9. Fitness for Purpose

(a) To the maximum extent permitted by law, you agree that you do not rely on our skill or judgement in relation to the suitability of any services for a particular purpose.

(b) The content of, or any opinion expressed does not represent the views of Cleaning Services in respect of the content.

(c) By using the Website, all users agree and acknowledge that Cleaning Services accepts no responsibility for the accuracy and all users release and forever hold harmless Cleaning Services from any liability howsoever caused.

(d) Views expressed by anyone you connect with through Cleaning Services are not endorsed by Cleaning Services.

(e) The information including statements, opinions, documents and materials contained on the Website is for general information purposes only. Cleaning Services does not take into account your specific needs, objectives or circumstances, and it is not medical or professional advice or services. Any reliance you place on Cleaning Services is at your own risk.

(f) To the maximum extent permitted by law, Cleaning Services excludes all liability for any loss or damage of any kind (including special, indirect or consequential loss) arising out of or in connection with Cleaning Services except to the extent that the loss or damage is directly caused by Cleaning Services ’s fraud or wilful misconduct.

10. Client responsibilities

The Client warrants and agrees that:

(a) they have inspected the premises and confirm that the environment is safe for the cleaner to perform the required services. The Client must report any hazards in writing prior to or upon the cleaner’s arrival;

(b) they will comply with all applicable laws and regulations relating to the engagement of the cleaner, including all relevant workplace and occupational health and safety laws, policies, and procedures;

(c) they are fully responsible for the conduct and safety of any pets on the premises during the service, including any actions taken by pets that may impact the cleaner or the work being undertaken;

(d) they are responsible for ensuring that furniture is moved to a safe location, and that electricity, hot water, and access to the premises are available and functioning on the day of the scheduled clean;

(e) n the event of extreme heat (temperatures exceeding 35°C), the Client is requested to provide a fan or air conditioner to ensure a safe and comfortable working environment for the cleaner during the service;

(f) the cleaner is able to gain access to the premises on the scheduled day of cleaning;

(g) if the Client will not be present, keys must be provided in advance and clear instructions given regarding access;

(h) there is suitable car parking is available for the cleaner;

(i) if on-site parking is not available, the Client must inform the cleaner in advance of the location of the nearest public or private parking;

(j) any public parking costs incurred will be charged to the Client and added to the invoice;

(k) any failure to provide access on the day of the clean without prior notice will result in a 100% lock-out fee being charged.

11. Exclusions

The parties agree that the following services and circumstances are expressly excluded from the scope of cleaning services provided:

(a) There will be no specialised cleaning of antiques, valuables, delicate items, or artworks in a client’s home. These items are excluded due to their fragility and potential for damage. Cleaning Services accepts no liability for any pre-existing damage to the property or to personal items, including antiques, valuables, paintings, or other delicate possessions.

(b) There will be no cleaning of pet waste such as dog faeces or kitty litter, nor any cleaning of human waste or vomit in a client’s home.

(c) Cleaning Services will not be liable for lost keys where the client has instructed us to leave them in an unsecured location (e.g. under a rock, in a letterbox, behind a plant, etc.). In the event that a key is lost due to our fault, we will cover the cost of replacement.

(d) Window cleaning will be limited to ground-level windows, both inside and out, and only up to a maximum height of two (2) metres.

(e) Oven cleaning will not include removal of the oven door glass unless the client has already removed it. Self-cleaning (pyrolytic) ovens are excluded and will not be cleaned.

(f) Mould on ceilings, including in bathrooms, will not be cleaned due to the presence of spores and associated health risks.

(g) Ceiling-mounted air conditioners, out-of-reach light fittings, and ceiling fans will not be cleaned due to height restrictions. These items may only be dusted using an extended dusting pole.

(h) For exit cleans only, the client is required to take and provide before and after photos of the property to Cleaning Services to confirm the scope and completion of work.

12. Linked sites

Cleaning Services may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites.

13. Intellectual property rights

Unless otherwise indicated, we own or license from third parties all rights, title and interest (including copyright, designs, patents, trademarks and other intellectual property rights) in the Website and in all of the material (including all text, graphics, logos, audio and software) made available on the Website (Content).

Any reproduction or redistribution of the Website or the Content is prohibited and may result in civil and criminal penalties. All other use, copying or reproduction of the Website, the Content or any part of it is prohibited, except to the extent permitted by law.

14. Your Obligations

You must:

(a) not do any act that we would deem to be inappropriate, is unlawful or is prohibited by any laws applicable;

(b) not use the Website to defame or libel us, our employees or other individuals;

(c) use the Website only for purposes that are permitted by the Terms and any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions;

(d) not use, copy or distribute (or attempt to use, copy or distribute) content without our express permission;

(e) not interfere (or attempt to interfere) with any security-related or other features of the Website;

(f) not use for the Website for anything that is discriminatory, unlawful, misleading, offensive, defamatory, distressing, harmful, intimidating or harassing;

(g) not use the Website in connection with any commercial endeavours except those that are specifically endorsed or approved by us;

(h) not use the services or Cleaning Services for any illegal and/or unauthorised use;

(i) abide by all of Cleaning Services policies as posted on the Website as amended from time to time;

(j) confirm that you have not been convicted of any criminal offence, sexual offence or any offence relating to the safety of children or vulnerable persons;

(k) confirm that you are not required to register as a sex offender in any jurisdiction or with any governmental entity; and

(l) confirm that you will act in good faith and not misuse the Website or cause harm or damage to Cleaning Services.

We reserve the right to reject a registration or remove a profile from Cleaning Services at our sole discretion and without notice.

15. Warranties and Disclaimers

To the maximum extent permitted by law, including the ACL, we make no warranties or representations, including but not limited to warranties or representations that the Website will be complete, accurate or up-to-date, that access will be uninterrupted or error-free or free from viruses, or that Cleaning Services will be secure.

Subject to those rights that cannot be excluded under the ACL, our liability (and any third-party supplier’s liability) for a breach of a non-excludable condition or warranty is limited, at our option, to the supply of equivalent services, the repair of the services, the payment of the cost of replacing the services or of acquiring equivalent services.

In no circumstances are we liable for any special, indirect or consequential loss, even if you advise us of any special circumstances or such loss was reasonably foreseeable.

We reserve the right to restrict, suspend or terminate without notice your access to the Website at any time without notice and we will not be responsible for any loss, cost, damage or liability that may arise as a result.

You acknowledge that Cleaning Services is intended to facilitate the interactions between different parties. We hold no liability to you as a result of any conduct of the parties or the misuse of your content by any party.

16. Indemnity

To the maximum extent permitted by law, you must indemnify us, and hold us harmless, against any liability suffered or incurred by us arising from or in connection with your use of the Website or any breach of these Terms or any applicable laws by you. This indemnity is a continuing obligation, independent from the other obligations under these Terms, and continues after these Terms end. It is not necessary for us to suffer or incur any liability before enforcing a right of indemnity under these Terms.

You agree to release, indemnify and hold us and its officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including lawyers’ fees) arising out of or in connection with: (i) your use of the services; (ii) your breach or violation of any of these Terms; (iii) Cleaning Services’ use of your content; or (iv) your violation of the rights of any third party.

17. Events Beyond Control

Neither party shall be liable to the other party for any loss caused by any failure to observe the terms and conditions of this agreement, where such failure is occasioned by causes beyond its reasonable control including but not limited to by fire, flood, riot, strike, war, pandemic, restrictions and prohibitions or any other actions by any government or semi government authorities.

18. Termination

We may terminate or suspend the services at any time. Termination is effective the day notice is received, or such later date as specified in the notice. We may remove anyone from the system. You may cease using the Website at any time.

19. Changes to the Terms

Please be aware that we may modify these Terms at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our Website. Please check back from time to time to review our Terms.

20. Jurisdiction and governing law

Your use of Cleaning Services and these Terms are governed by the law of Victoria and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria.
